10. Limitation of Liability

In no event will the BESTDEALTODAY entities be liable to you for any indirect, incidental, special, consequential, or punitive damages (including damages for loss of profits, goodwill, or any other intangible loss) arising out of or relating to your access to or use of, or your inability to access or use, the site, or any materials, or user content available through the site, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not any BESTDEALTODAY entity has been informed of the possibility of damage.

Except as provided in section 17.4(iii), the aggregate liability of the BESTDEALTODAY entities to you for all claims arising out of or relating to the use of or any inability to use any portion of the site or otherwise under these terms, whether in contract, tort, or otherwise, is limited to $100.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. Accordingly, the above limitation may not apply to you.

Each provision of these terms that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is intended and allocates the risks between the parties under these terms. 12. Dispute Resolution and Arbitration

12.1 Generally: In the interest of resolving disputes between you and BESTDEALTODAY most expediently and cost-effectively, you and BESTDEALTODAY agree that every dispute arising in connection with these Terms will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited judicial review. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms, whether based on contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND BESTDEALTODAY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

12.2 No Class Actions: YOU AND BESTDEALTODAY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless you and BESTDEALTODAY agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

By accessing the Site, you consent to receive certain electronic communications from us as further described in our Privacy Policy. You agree that any notices, agreements, disclosures, or other communications we send to you electronically will satisfy any legal communication requirements, including those communications being in writing.

14. Refund & Return

14.1 We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations or that any errors in products or services will be corrected.

14.2 Returns: You have 30 calendar days to return an item from the date you received it. To be eligible for a return, your item must be in the same condition, you received it. 14.3 Refunds: Once we receive your item, we will inspect it and notify you that we have received your returned item. We will immediately notify you of the status of your refund after inspecting the item. If your return is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of days, depending on your card issuer’s policies.

14.4 Guarantees for Faulty Goods: Free of charge, 2-year guarantee for all goods purchased within the EU. You always have the right to a minimum 2-year guarantee at no cost, regardless of whether you bought your goods online, in a shop, or by mail order. If goods you bought anywhere in the EU(In this case, the 28 EU member states + Iceland, Liechtenstein, and Norway) turn out to be faulty or do not look or work as advertised, we will repair or replace them free of charge or give you a price reduction or a full refund. You can usually only ask for a partial or full refund when repairing or replacing the goods is impossible.

14.5 To be eligible for a return, all items must be in the same condition when purchased (unmodified and unaltered), with all original packaging attached and packed in an appropriate shipping container.

14.6 We will not refund any customer whose order is not received because the shipping address provided during the checkout procedure was inaccurate or incomplete unless that order is classified as undeliverable and returned to us. In a case of a missing package on orders placed in any city in the world, we will offer a refund or send out a new package, this only applies to packages that were never delivered to you. If your package was delivered, but you did not receive it, you must contact the post office and resolve the issue. You are responsible for contacting the post office and filing a claim for the missing package.

14.8 Approved refund will be processed to the original order payment method and in the original currency. You will receive the credit within a certain amount of days, depending on your card issuer’s policies. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. Credit will include the original purchase price minus the shipping and handling fee. The warranty packages and express delivery fees you added to your order are non-refundable.

15. Shipping & Delivery

This shipping and delivery policy (“Shipping and Delivery Policy”) covers the shipment and delivery of any items you purchase from BESTDEALTODAY.

This Shipping and Delivery Policy is subject to the Terms of Use for the BESTDEALTODAY website on which you made your purchase.

15.1 Accuracy of Billing and Shipping Information: Upon completing your order, we assume your address to be verified, correct, and double-checked. However, if it is discovered that you provided an incorrect or incomplete shipping address, we will endeavor to contact you within 24-48 hours of purchase via email or phone to verify the address you provided or to request a new address to which your orders can be delivered. If, within seven (7) days after our initial attempt to contact you, we cannot communicate with you, or if you fail to provide us with a completely valid address for delivery, we shall store your orders and await further instructions from you. Under no circumstance will we be liable for any cost, loss, depreciation, or damage arising from delay in delivery or non-delivery due to the incorrect or incomplete shipping address details provided by you.

15.2 Shipping Provider: We ship out all orders placed  BESTDEALTODAY via our dedicated third partner logistics. Shipping methods are chosen to optimize shipping time, security, and delivery.

15.3 No-shipping Regions: We do not provide shipping of our products to Latvia, Estonia, and Lithuania.

15.4 Shipping & Tracking: We ship out orders in 3 business days, except on weekends and holidays. However, we must wait for the carrier to provide the tracking number. It may take up to 3 working days for your tracking number to be sent to you. Some carriers do not provide any tracking information updates until the shipment arrives at the facility of the “Final mile” carrier in the destination country.  Please, be advised that this feedback loop delay does not affect the overall delivery time.

15.5 Shipping Costs: We offer Free Shipping for all orders. If you prefer a faster shipping method, you need to pay an extra shipping fee; shipping costs for your order are non-refundable.

15.6 Timeframes for delivery: All orders will deliver within 7-25 working days. 95% of orders are delivered within 15 working days. We choose International Express shipping lines whenever available to your location. Please be aware that the date of delivery for your order may vary due to carrier holidays, last-mile delivery at the local post, shipping practices, delivery location, the method of delivery, and the total quantity of items ordered. In addition, all orders are subject to product availability; your order may be delivered in separate shipments. If an item in your order is unavailable, we will ship you the available part of your order. When that item becomes available, we will ship you the rest of your order.

15.7 When placing an order, you undertake that all details you provide to us are true, current, complete, and accurate, that you are an authorized user of the credit or debit card used to place your order, and that there are sufficient funds to cover the cost of the Services so that we can complete your transactions and contact you as needed. The transfer of risks and rewards occurs when the carrier has loaded the goods.

15.8 We put substantial effort into preventing shipping damage; however, it occasionally occurs. Under no circumstance will we be liable for any cost, loss, depreciation, or damage of packages during shipping. If you receive a shipment with visible damage and discover the product is damaged during shipping, immediately contact the carrying trade company to file a complaint. We also advise saving all packaging details and damaged products.

15.9 For items not received, you can send us a claim within sixty days from the order date. We are not liable for claims received after those sixty days from the order date. After receiving a claim, we will open an investigation process with our shipper. In case of confirmed non-delivery, the carrier typically will find and deliver your package. In case of confirmed non-delivery and your package is not found, we will refund you or replace your order.

15.10 Order Tracking: You can track your orders in the Order Tracking section using the tracking number provided within the shipping email you received when your order was processed. This Shipping and Delivery Policy is subject to change without notice. The version of this Shipping and Delivery Policy in effect at the time of your purchase will govern your purchase. BESTDEALTODAY recommends you print or otherwise retain a copy of this Shipping and Delivery Policy at the time of your purchase.

15.11 Cancellation and Change of Delivery Address: You have 12 hours from placing your order to request a cancellation and change the delivery address of the products purchased. Kindly contact us using the contact form or our 24/7 Chat support located throughout the Site in the lower right corner.

After 12 hours, the order may begin processing and cannot be canceled or modified. Please note that we process all orders as soon as possible so that you can receive your order as soon as possible, so we recommend that if you wish to cancel or change the shipping address of an order, you may do so through the link above on the same day that you made the purchase. In this sense, after the period identified in this clause, you should know that it is possible that your order has already been processed, and it is not possible to carry out your request.

16. Price & Payment

The price of BESTDEALTODAY Product(s) is quoted on the Website. The prices are exclusive of VAT.

Prices and delivery costs are liable to change at any time. However, changes will not affect orders because we have already sent you an Order Confirmation.

Payment for all orders must be made by Credit, Debit card, or PayPal payment method on the checkout page. We accept payment from major Credit and Debit cards, including Visa, MasterCard, and JCB. Payment will be processed in EUR or USD. If your banking currency differs from EUR or USD, your issuing bank may apply a Forex rate. Please note we have no control over the exchange rate applied by your banking institution.

Payment is to be made at the moment of checkout by purchasing the product or service through our secure shopping cart. Once payment is received, your purchase will be scheduled to be completed, and you will receive an email to that effect.

The payment amount will be deducted from your card once the order has been dispatched.

You should be aware that online payment transactions are subject to validation checks by your card issuer. We are not responsible if your card issuer declines to authorize payment for any reason.

We carry out a standard pre-authorization check on your payment card when you place an order, and the Product(s) will not be dispatched until payment for the total costs of the order has been authorized. Your card issuer may charge you an online handling fee or processing fee.
